Working With an Agent

Protective Agency vs Port Agency: What Is the Difference?

Short answer

A port agent is appointed by one party to execute the port call. A protective agent is appointed separately by another interested party to observe and report on that same call. The protective agent monitors activity, milestones, service delivery and disbursement-related activity, and reports independently.

Why the arrangement exists

In many charters the party bearing the commercial consequence of a port call is not the party that nominates the agent. That creates an information asymmetry: the owner carries exposure while the charterer's agent holds the operational picture, or the reverse.

Protective agency closes that gap without disrupting the port call.

What a protective agent does

  • observes port-call activities and records milestones
  • monitors cargo operations and stoppages as they occur
  • notes husbandry and supplier activity
  • records documentation and local service delivery
  • observes disbursement-related activity
  • reports independently to the appointing party

When it is worth appointing

SituationWhy protective agency helps
Charterer nominates the agentThe owner obtains an independent operational record.
First call at an unfamiliar portGives you a second, independent read on what is actually happening.
Commercially sensitive operationMilestones are documented as they happen, not reconstructed later.
Recurring trade with rising costsProvides a consistent basis for comparing calls.
Remote management across time zonesReporting arrives without having to chase for it.

Setting up a protective appointment

  • identify the appointing party and its interest
  • define precisely what is to be monitored
  • agree the reporting frequency and format
  • agree what information access is expected
  • confirm the protective agent will not direct the call
  • issue escalation contacts and decision authority
  • appoint before arrival, not after
  • agree the closing report format and timing

Where delay usually develops

  • appointment made after the vessel has arrived
  • no agreed reporting frequency
  • expectations that the protective agent can intervene

What the principal should prepare

  • the charterparty or commercial terms relevant to the call
  • the identity of the nominated agent
  • the specific matters to be monitored
  • reporting requirements and escalation contacts

What Vandyvah can coordinate

  • independent milestone reporting through the port call
  • prompt notice of apparent cost or delay drivers
  • records supporting each observation
  • a written protective-agency report on completion
